These terms and conditions establish the pre-contractual information related to contracts concluded at a distance on the page www.marcolino.pt (hereinafter the “Site”) referred to in article 4 of Decree-Law No. 24/2014 of 14 February and , as well, establish the general conditions of use of the Site itself.

The domain www.marcolino.pt is owned by Equação do Tempo, Lda., NIPC 507 944 097, headquartered at Rua de Santa Catarina 84, 4000-441 Porto, hereinafter referred to as Marcolino.

Whether browsing the website www.marcolino.pt or purchasing any product or article through the online store available there presupposes full knowledge and unlimited, unconditional and irrevocable acceptance of these terms and conditions.

Marcolino may, at any time, freely modify the terms and conditions in order to adapt them to the applicable legislation, without the need for any prior notice, so it is advisable to consult and read them regularly.

1.1 - The Site is a web-based platform for the promotion, dissemination and sale to the public of watch and jewelery products of brands and models marketed by Marcolino.

1.2 - These terms and conditions apply only to all visitors and users of the website and to all commercial transactions carried out through the website, therefore, they do not apply to sales made in stores used by Marcolino.

2.1 - The use of certain features of the Site, in particular, the purchase of any product sold on the Site, requires the creation of a user account and, for this purpose, the user will be asked to provide elements that allow their identification. Such elements are restricted to those necessary for Marcolino to be able to recognize, contact and provide a personalized and quality service to the users of the Site and, in the case of purchases on the Site, to the correct and complete identification of the buyer for the purposes of billing and shipping items.

2.2 - The use of the Site is only allowed to citizens of legal age with a domicile in one of the States listed in clause 8.1

3.1. The User pledges to comply with and respect these terms and conditions.

3.2. In particular, without excluding any other obligations defined herein that are applicable to you, the user pledges to:

3.2.1. refrain from introducing, storing or disseminating defamatory, obscene, insulting, xenophobic and / or any other content that violates general principles of law and public order through the website;

3.2.2. keep, and not disclose, your password to enter the Site in order to prevent third parties from accessing your account;

3.2.3. do not use false identities;

3.2.4. provide personal data and the correct addresses so that Marcolino can properly process orders;

3.2.5. keep the registration data of your user account up-to-date, communicating to Marcolino, by updating your registration, any changes to them.

3.3. Marcolino reserves the right to delete any user account that does not strictly comply with the obligations referred to in this chapter.

3.4. Likewise, Marcolino declines any and all responsibility for any delay or impossibility of processing the order, namely in the act of delivery, due to error or insufficiency of the data communicated by the user.

4.1. Marcolino takes into account the information related to the essential characteristics of the products through technical descriptions shared by its suppliers, photographs and videos that illustrate the products sold, in strict respect for the best standards in the market. Such information is purely indicative, which is why Marcolino recommends that the user consult the detailed description of the products in order to obtain complete information about the respective characteristics.

4.2. The user declares to accept that Marcolino is not directly or indirectly responsible for any information, content, statement or expression contained in the description of the products advertised on the Site.
 
4.3. In the event that the information presented on the Site does not correspond to the actual characteristics of the product, the user has the right to terminate the purchase and sale contract under the applicable legal terms.
 
4.4. Prices and specifications are subject to change without notice. In the event of a stockout of a certain product, Marcolino does not guarantee its replacement in the same way that it does not guarantee that such replacement, if it happens, will not imply an update of the price. When replacing any product ordered by the user whose stock has broken, with an updated price, Marcolino will only process the respective order after the user expressly and in writing accepts the new price. If the order is processed and there is still a stockout situation, Marcolino will communicate this to the user and make the due refund of the price paid by the user when ordering the product whose stockout occurs, within the maximum period 30 days from the knowledge of the said stock out.

8.1 - Marcolino will only ship orders to the following territories: Germany, Andorra, Austria, Belgium, Bulgaria, Croatia, Denmark, Slovakia, Slovenia, Spain, Estonia, Finland, France, Greece, Netherlands, Hungary, Ireland, Iceland, Italy, Latvia, Lithuania, Luxembourg, Monaco, Norway, Poland, Portugal, Czech Republic, Sweden, and Ukraine.

8.2 - If, after payment confirmation, the ordered product(s) are out of stock, the user will be contacted by Marcolino to be informed about the delivery time or to change their order.

8.3 - Orders placed on the Site will be shipped from Monday to Thursday between 9:00 AM and 5:00 PM by DHL (shipments outside the territory of Portugal) and by CORREOS EXPRESS (shipments within Portuguese territory).

8.4 - Without prejudice to the provisions in 7.5, shipping will be free for orders placed within mainland Portugal, with a value exceeding €49, provided they are not on promotion or sale.

8.5 - The average delivery time is 2 to 3 days for deliveries within Portugal and 2 to 5 days in other cases. The delivery times indicated in this clause are merely indicative and are based on the information provided by the carriers responsible for shipping the orders. Marcolino is not responsible for any delays incurred by the carrier and will not accept any responsibility for non-compliance with the indicative deadlines mentioned herein. Similarly, Marcolino will not assume any responsibility for delays related to customs clearance of orders or payment approval, although it commits to cooperating with the user to minimize such delays.

8.6 - All delivery options available for each item and destination will be displayed during the purchase process.

8.7 - Orders resulting from transactions carried out on the Site will, as a rule, be shipped by 3:00 PM on the business day that payment confirmation is received from the user, except on Fridays. If the mentioned payment confirmation occurs after 12:00 PM on a given day, the order will be shipped on the next business day, provided no circumstances outlined in these terms and conditions prevent it.
